What Can Happen if I Am Caught Driving Under the Influence Again?
Pennsylvania law considers anyone with more than a .08% Blood Alcohol Content (BAC) level to be under the influence and subject to criminal charges. If you’re stopped and a test proves you have a BAC of between .08 and .099, and this is a second offense, you face:
- Five days to six months in jail
- $300 to $2,500 in fines
- A one-year license suspension
You will also be required to have an ignition interlock device on your car for one year. The device won’t allow you to start your car unless you pass a BAC test. If your BAC is over the .099 level at the time of your arrest, and/or you have additional prior DUI’s, you will face heavier fines, possible jail time, and you may be ordered into a treatment program.
