The Probate Process

Even though every estate has different debts, assets and people named in the will, the general probate process is always the same:

  • The value of the assets is determined.
  • Creditors, the Social Security Administration and insurance companies are notified that the person has died. Creditors are allowed to make a claim on the assets to repay outstanding debts.
  • Beneficiaries are made aware of the distribution of assets.
  • The executor of the will (administrator) determines who is named in the will and which assets go to whom.
  • The probate court oversees the distribution of assets.

Avoiding Probate

Probate is necessary anytime there is a will. However, it can be avoided altogether by passing assets through a trust. We can advise you on whether a trust or will best fits your goals, and help you create the necessary documents.
