Ohio's Workers Compensation Permanent Disability Claims

Workers' Compensation Attorneys for Ohio Workers

Representing People Like You Since 1997

The workers’ compensation system provides much-needed benefits for those who suffer work-related injuries or illnesses. It is designed to cover medical expenses and replace lost income. Unfortunately, these benefits are routinely denied by insurance companies and employers for various reasons.

If your workers' comp benefits were denied or if an employer refused to pay them, a skilled and experienced workers' compensation lawyer can prove to be an invaluable ally.

At Mansmann & Moore, Attorneys at Law, our lawyers have extensive experience representing injured workers before various agencies and courts. If you have been injured at work, please contact our Ohio office.

Permanent Total Disability Compensation

Our attorneys have vast experience in Ohio workers’ compensation law and focus much of their practice on securing permanent total disability compensation. In order to recover this benefit, a worker must be permanently prevented from performing all forms of sustained employment.

The application for these benefits focuses on two main issues:

  • What are the injured worker’s residual functional physical and/or psychological limitations based upon the allowed conditions in the claim?
  • Do other non-medical disability factors (e.g. age, education, prior work history, etc.) permanently stop the injured worker from obtaining any employment, not just the injured worker’s previous employment?

Permanent total compensation continues for the remainder of the injured worker’s life. However, these benefits can be terminated if certain events occur. Our attorneys will take the time to explain how the process works and answer any questions that you may have.

Statutory Permanent Total Disability Compensation

If an injured worker suffers a loss of two or more specified body parts ¾ a hand or a foot ¾ the worker is entitled to receive “statutory” permanent total disability compensation for the remainder of his or her life, regardless of whether or not that individual is capable of working. Our experienced workers' compensation lawyers will help make sure you receive the benefits you need for your injuries.
